ARC Meeting, Sunday, January 6, 2019

The ARC will meet on Sunday, January 6, at 2:00 p.m. to review an application submitted by Don and Dawn Marano to replace all exterior windows of their unit at 8231 Main Street with hurricane-rated windows. Any interested unit owner may attend the meeting to be held at Buzz Fender's unit.

1/7/19 Regular Monthly Board Meeting Cancelled

Dear Neighbors,

As the board has no new or old pending business, the regular monthly meeting has been cancelled for January.

However, SBPOA members are reminded that our annual meeting is scheduled for January 27, 2019. You should have received your voting packet via email in December. Please be in touch with me if you have not received it or are having difficulties printing the documents.

Upcoming Board Election, Important Update and FYI

Dear Fellow Residents,

As you know, the Seagull Bay POA Annual Meeting is scheduled for Sunday, January 27, 2018, during which the 2019 board election will be conducted. The ballot vote at the Special Membership Meeting, held on April 22, 2018, to amend Article 4 Section 1 of our Covenants, Conditions, Restrictions and Easements, which would have reduced the required number of board members from six to five was not able to be conducted since a membership quorum was not achieved at that meeting. Therefore, the number of board members required for 2019 remains at six.

Al Marcus and Dawn Marano of the current board are willing to continue serving and will appear on the ballot. Mike Aden will also appear as a candidate. To date the board has not received word from any other members of the community willing to appear on the ballot. Unless this changes before the Annual Meeting packet is sent out later this month, there will be three write-in blanks on the ballot. As a write-in candidate, an SBPOA member could be seated on the board with as few as one vote. Nominations cannot be taken from the floor.

Hopefully the write-in remedy would allow us to seat a full board of six. If not, Seagull POA could and most probably would pass into receivership, and the court would appoint a receiver who “shall have all of the powers of the board and shall be entitled to receive a salary and reimbursement of all costs and Attorney’s fees payable from the association funds.” (Florida State Statute 720.3053)

If you are still considering volunteering to be on the board and having your name appear on the ballot, we urge you to contact one of our current board members by December 15, 2018.

Also, we remind you to submit any items you wish added to the Annual Meeting agenda by that date.
